Indemnity Agreement, Waiver of Liability, Release and Risk Assumption:

Purchaser/User/Recipient assumes all risk related to and/or arising from the ownership and use of the merchandise purchased and agrees to indemnify and hold NGW (herein named "Vendor"), its subsidiaries, affiliates, partners, officers, directors, employees and agents harmless from any and all claims or causes of action, including legal fees and expenses brought by any person or entity against Vendor related to and/or arising from its ownership and/or use of the merchandise. Vendor does not warrant that any individual or company may legally purchase, possess, sell or carry any items offered. It is the responsibility of the Purchaser/User/Recipient to comply with federal, state and local laws. By purchasing any item, the Purchaser/User/Recipient warrants that he is in compliance with all federal, state and local laws, he is legally allowed to purchase these items, and he understands and agrees to all terms and conditions.

Purchaser/User Agrees to Accept Terms:

By purchasing goods, purchaser agrees to use product in legal and appropriate manner. Purchaser represents himself as of legal age, legal mind, and having legal intentions. Billing information and payment type will be provided via legal means from purchaser with legal right to purchase. Purchaser shall be no less than 18 yrs and of legal age in the area being purchased and shipped. The Vendor will be held harmless by purchaser who fails any aspect of purchasing criteria.

Purchaser/User assumes full responsibility for compliance with all current and future applicable state and federal laws and regulations in regard to proper and legal use of product by himself or others. The Vendor may not be held responsible for illegal or inappropriate use of product, including but not limited to damages resulting from improper use, illegal use, use by minor representing himself as adult, etc. Transactions and agreements with the Vendor shall be construed under and according to the laws of the State of Florida. Purchaser/User hereby agrees that any claim arising out of the products purchased hereunder shall be brought in Fort Myers, Florida.

Website may not be duplicated in any manner without the express and written consent of Management. All website content including language or images, information provided via phone, email or facsimile, and this notice may not be duplicated without written consent. All information contained herein is property of the Vendor and any duplication of said materials will be prosecuted to the fullest extent of the law and considered infringement of intellectual property law.

In the event of damage occurring during transport of goods, Purchaser/User shall notify Vendor via telephone or email within 24 hrs of receipt of merchandise. Claims for defective or damaged merchandised will not be processed if submitted more than five days after delivery.

Purchaser/User shall indemnify, defend and hold harmless Vendor from/against loss, damages, penalties, fines, costs or expenses including, without limitation, reasonable attorney's fees and costs incurred as a result of any damage or injury to persons or property resulting from this transaction. In addition, Vendor shall not be considered liable for any special, incidental or consequential damages, including loss of income or profits resulting from use, legal or otherwise of product. In the event Vendor is required to employ counsel or other means to enforce any or all website terms and conditions, Vendor will recover reasonable attorney's fees, any third party fees and costs incurred in any litigation.

All claims of fraudulent use of credit cards, including use by an unauthorized person or minor will be researched and prosecuted to the fullest extent of the law. All information provided during said incident including shipping information and billing address will be released to investigative and prosecuting authorities, credit card company, billing party of credit card, any public or consumer group dedicated to preventing and prosecuting credit card fraud, affiliated website partners, and may be posted on actual website.

Purchaser/User will pay Vendor full compensation for product as set forth by pricing contained in this website at the time of purchase. Vendor will not be held responsible for any merchandise returned without authorization.

Return Policy:

Contact Customer Service before returning any item.
All returns require a Return Authorization Form to be processed.
All returns must be received within 14 days of delivery.
Shipping charges are non-refundable once the order has shipped.
Return shipping charges are the responsibility of the purchaser.
There will be a 25% processing fee on all returned, refused or undeliverable items.
No refunds will be issued on used, damaged or items not returned in original packaging.
No refunds will be issued on modified or customized items.
We are not responsible for items returned without authorization.

Note: All items must pass quality control and are thoroughly checked before shipping. Check your package at the time of delivery for any visible damage to the packaging. It is the responsibility of the customer to notify the carrier immediately with any loss or damage claims. It is the customers responsibility to follow up on damage and lost item claims with the carrier. All items are insured at retail value. Customer Service must be notified within 48 hours of a damage or loss claim being filed.

Privacy/Spam/Abuse Policy

All customer information is confidentially handled. No information on our customers is sold or released to any third parties except to the extent necessary to complete the order. In a case where slander or libel may have been committed by the customer, documented customer communications may be released.

Customers shall not, nor shall they permit or assist others to abuse or fraudulently use this website, including but not limited to the following: Sending unsolicited email, obtaining or attempting to obtain products by any means with intent to avoid payment, unauthorized access or any attempt thereof to alter any information of any customers, knowingly engaging in any activities that will cause a denial of service (e.g., profanity), any attempt to interfere with the network, violating the law or aiding in any unlawful act.
